ON 01.07.2021, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:

                             JUDGMENT

The above Contempt of Court case has been filed alleging

non compliance of the directions and orders passed by this Court in

Anx.I judgment dated 15.10.2018 in WP(C).No.10061/2018.

2. Today when the matter has been taken up for

consideration, Sri.Saigi Jacob Palatty, learned Senior Government

Pleader appearing for the respondent would submit that on the basis

of instructions that hearing in the matter has already been

conducted by the respondent Tahsildar on 12.02.2021, and that the

petitioner and contesting respondents in the WP(C) had sought for

further time to produce the documents and, thereafter matter was

entrusted to the Taluk Surveyor to conduct survey and

measurement, and that in view of pandemic issues survey process

has not been completed. Further that, it will be ensured that the

survey and measurement process will be duly completed by the

Taluk Surveyor with due prior notice to both sides and copy of the

survey report will be given to both sides, and thereafter, proceedings Cont. Case (C) No. 424 of 2020

will be finalized by the respondent Tahswildar within one month

from the date of receipt of the survey report.

3. Accordingly, two months time is granted to the

respondent to complete all the necessary formalities to ensure

compliance of the directions in Anx.I judgment in the above WP(C).

With these observations and directions, the above

Contempt of Court case will stand disposed of.
