JUDGMENT
These Writ Petitions are the fall out of a Scheme implemented by the
Government whereby it was decided to assign land to the members of the
Scheduled Tribes of Pathanamthitta District invoking the provisions of the Kerala
Land Assignment Act and the Rules framed thereunder under a Scheme known as
the "Ashikkum Bhoomi Adivasikku". The entire controversy revolves around the
inclusion of property owned by a certain Thresiamma in the Scheme. A complaint
was lodged by the petitioner in W.P.(C) No.21747 of 2019 and Smt. Sreeja R. before
the Kerala State Commission for Scheduled Castes and Scheduled Tribes,
Thiruvananthapuram and by order dated 15.2.2019 produced as Ext.P13 in W.P.(C)
No.31246 of 2019, the Commission took the view that the property of the aforesaid
Thressiamma was not suitable and issued further directions to the District Collector
to initiate action against the persons who were responsible for identifying and
selecting the said property. The prayer in W.P.(C) No.21747 of 2019 is for a
direction to the District Collector, Pathanamthitta not to include the property of the
aforesaid Thressiamma in the Land Bank of the District Collector, Pathanamthitta, or
to purchase the property under the Scheme.
2. For the sake of convenience, reference to parties and Exhibits shall be
as per their description in W.P.(C) No. 31246 of 2019.
3. The Government of Kerala formulated a Scheme for the purchase of W.P.(C).Nos.21747 & 31246 of 2019 7
land for landless Scheduled Tribe families as per order dated 03.09.2013. As per the
Scheme, which is named as "Aasikkum Bhoomi Adivasikku", the Government came
up with an offer to provide financial assistance not exceeding Rs.10 lakhs to
purchase land, which is suitable for residence and agricultural purposes for landless
families of the Scheduled Tribe Communities. As per the Scheme, the beneficiaries
were to find out the land, which shall not be less than 25 cents and not more than
One Acres and the fact has to be informed to the Tribal Extension Officer. The Tribal
Extension Officer in the presence of the beneficiary and the land owner would
inspect the property and would ensure that the property is fit for dwelling and
cultivation. After obtaining consent letter from the land owner and after complying
with all procedural formalities, a Committee which consists of the District Collector,
the District Planning Officer, the Tribal Development Officer and the Tahsildar
concerned along with the Tribal Extension Officer is required to inspect the property
and verify the proposal. Thereafter, sanction is to be accorded for purchase of the
property.
4. The 8th respondent in W.P.(C) No.31246 of 2019, Smt. Thressiamma,
was the owner in title and possession of 1.8049 Hectors of land comprised in
Sy.No.780/1-2-3402 of Kollamula Village. The petitioners herein, who are the
beneficiaries of the Scheme, pointed out the property of the 8th respondent and
requested for purchasing the same for their residence and agricultural purposes.
The property was verified by the Tribal Extension Officer and he was satisfied that
the property was fit for purchase under the Scheme. As reported by him, the
property was verified by the District Collector and other representatives and it was W.P.(C).Nos.21747 & 31246 of 2019 8
found that the property was suitable for purchase under the Scheme. The property
was valued and the Tahsildar concerned fixed the market value of the land at
Rs.38,500/- per cent. The Purchase Committee conducted a meeting on 05.12.2017
and decided to purchase 1 Hector 80.49 Acres of land at the rate of Rs.95,062/- per
Are (Rs.38,486/- per cent). This was agreeable to the land owners as well. In
terms of the Scheme, sale deeds were executed by allotting 25 cents each to the
beneficiaries and it was registered. However, the sale consideration was not paid to
the land owner.
5. Serious controversy erupted thereafter as a complaint was received
that the property was unfit for residence and it was over valued. The Tahsildar
concerned was directed to conduct an enquiry, who submitted a report that the
actual value of the property is Rs.51,290/- per Are. However, the land owner
refused to part with the property for the said price. By order dated 27.03.2018, the
Purchase Committee cancelled the earlier decision to purchase the land.
6. While so, the Government came up with a new Scheme known as
Land Bank Scheme. As per the new Scheme, the land suitable for dwelling and
cultivation was purchased by the District Collector and the same was included in the
Government Land Bank. When the beneficiaries approach, the property is allotted
to the beneficiaries through the Tribal Resettlement and Development Mission
(TRDM) under the provisions of the Kerala Assignment of Government Lands to
Scheduled Tribes Rules, 2001. In terms of the new Scheme, several Tribals
approached the Tribal Resettlement and Development Mission and they also
requested that the property of the 8th respondent, Thressiamma be included. The
Panchayath Level Committee considered the request and about 27 applications
were found suitable. The District Level Committee which consists of the District
Collector, the Divisional Forest Officer, the District Survey Superintendent, the Tribal
Development Officer and the Panchayat Secretaries etc. met and six applications
were found suitable for allotment under the Land Bank Scheme. The property of the
8th respondent, Thressiamma was also included in the final list.
7. While things were progressing, the petitioner in W.P.(C)No.21747 of
2019 approached the 9th respondent and lodged a complaint. In his complaint, he
stated that the steps taken by the Revenue Authorities under the supervision of the
District Collector was not transparent.
8. The Commission, by Exhibit-P13 order which is impugned in the writ
petition, directed the District Collector to initiate action against the Officers
concerned after finding that the land of the 8th respondent was unfit for purchase
under the Scheme.
9. Sri. Madhu Radhakrishnan, the learned counsel appearing for the
petitioners in W.P.(C) No.31246 of 2019 submitted that Exhibit-P13 order is arbitrary
and illegal and passed in violation of the principles of natural justice. The least the
Commission could have done is to issue notice to the Committee headed by the
District Collector and seek their views before passing an order directing the
initiation of proceedings against the officers who were involved in the matter. It is
contended that the person who lodged the complaint is not a beneficiary under the W.P.(C).Nos.21747 & 31246 of 2019 10
scheme nor is he affected by the purchase in any way. It is pointed out that the
Commission merely acted upon the assertions made by the complainant and did not
care to take note of the procedure followed by the revenue authorities prior to
purchase of the property.
10. The District Collector has filed a counter affidavit wherein after
detailing the entire sequence of events, has stated that the District Collector was
not even made a party in the complaint and the revenue authorities did not get an
opportunity before the Commission to lay down the actual facts. It is contended
that the beneficiaries themselves had identified the plot and its value was fixed
after conducting due enquiries. In that view of the matter, whether the land is fit or
not should not have weighed with the Commission. It is further stated that the land
selected was fertile with lots of trees and with access to water. The complaint was
lodged with oblique motive to undermine the Scheme. Finally, it is stated that the
action taken by the District Administration and the members of the Committee was
clearly as per the stipulations in the Government Order and the guidelines issued
thereunder.
11. In W.P.(C) No.21747 of 2019, the contention of the petitioner is that it
is in clear violation of the provisions of the Scheme that the official respondents
decided to select the property of Thresiamma, the 8th respondent. The petitioner
would point out that the property of the 8th respondent was originally selected
under the "Aasikkum Bhoomi Adivasikku" scheme and later when complaints were
received, an enquiry was conducted and it was found that the land value was over W.P.(C).Nos.21747 & 31246 of 2019 11
valued. The Committee decided to cancel the purchase. However, after the Land
Bank Scheme was introduced, the very same property was again selected. It is
contended that the property of Thresiamma ought not have been included in the
Scheme.
12. I have considered the submissions advanced by Sri.Madhu
Radhakrishnan, the learned counsel appearing for the petitioners in W.P.(C)
No.31246 of 2019, Sri. O.V.Maniprasad, the learned counsel appearing for the
petitioner in W.P.(C) No.21747 of 2019 and Sri. M.K.Robin Raj.
13. In W.P.(C) 31246 of 2019, the challenge is directed against Exhibit P13
order passed by the Kerala State Commission for Scheduled Castes and Scheduled
Tribes, Thiruvananthapuram. What is apparent from the facts narrated above is that
as per the new Land Bank Scheme brought out by the Government after replacing
the "Aasikkum Bhoomi Adivasikku'' scheme, land is assigned to the beneficiaries
through the Tribal Resettlement and Development Mission (TRDM). As per the
Scheme, a copy of which is produced as Ext.R3(c), the applications filed by the
landless persons are inspected by the Panchayat Level Committee consisting of the
Tribal Extension Officer, Village Officer, Forest Range Officer and Panchayat
Secretaries. The applications which are found suitable are then forwarded to the
District Level Committee for scrutiny and finalization. The District Level Committee
consists of the District Collector, Divisional Forest Officer, District Survey
Superintendent, Tribal Development Officer and Panchayat Secretaries. The
Committee scrutinizes the application and finalizes the same. The 9th respondent W.P.(C).Nos.21747 & 31246 of 2019 12
Commission while interfering with the scrutiny process carried out by the
Committee and before ordering the initiation of enquiry against the officers has not
heard the District Collector nor was any notice issued to the Committee which was
in charge of the scrutiny of the applications under the Scheme. It appears that the
Commission, before passing the impugned order has only heard the complainant as
well as the Assistant Tribal Development Officer. After considering the report
submitted by the Assistant Tribal Development Officer, without any discussion
whatsoever, a one line order has been passed directing the District Collector to
initiate action against the errant officers. The reasons which persuaded the
Commission to pass such an order is not discernible. At any rate, no such order
could have been passed without hearing the District Collector, who was heading the
Committee which had scrutinized the applications for allotment of lands. In that
view of the matter, I have no doubt in my mind that Ext.P13 order dated 15.2.2019
passed by the Kerala State Commission for Scheduled Castes and Scheduled
Tribes, Thiruvananthapuram, cannot be sustained and the same will stand quashed.
14. Insofar as W.P.(C) No. 21747 of 2019 is concerned, the grievance of
the petitioner is regards the inclusion of property of the 8th respondent
Thresiamma in the Land Bank Scheme. As stated above, a detailed procedure is
prescribed at different levels before including the property in the Scheme and prior
to allotting the same to beneficiaries. It is borne out from the counter affidavits
that the property of Smt. Thresiamma has also been included in the Land Bank
Scheme and as per order dated 1.7.2019, the District Committee has decided to
purchase the land. If the petitioner is neither a beneficiary nor a person belonging W.P.(C).Nos.21747 & 31246 of 2019 13
to the Scheduled Tribe Community, he cannot justifiably raise any contention
attributing malafides to the District Level Committee. However, if the petitioner has
any grievance, he may approach the 3rd respondent and raise his complaints within
a period of three weeks from the date of receipt of a copy of this judgment. If any
such complaint is lodged, the 3rd respondent shall consider his grievance and place
it before the District Level Committee. The said Committee shall consider the
allegations made by the petitioner in W.P.(C) No.21747 of 2019 before finalizing the
applications.
With these directions, these writ petitions are disposed of.
