ORAL ORDER
Learned counsel for the petitioner is said to have
paid the entire fine amount. The same is not disputed by
Sri D.Narayana Swamy, learned counsel for the
respondent who is present before the Court.
2. I.A.No.2/2026 is filed to recall the order dated
11.07.2025 by which order, petition came to be dismissed
for non-prosecution. Since, the entire fine amount is paid
and the accused is in custody, in the interest of justice,
the order dated 11.07.2025 is hereby recalled.
3. After restoration, matter is heard.
4. I.A.No.1/2026 is allowed and delay of 271 days
is condoned.

5. A memo is filed on behalf of the petitioner
reporting the payment of entire fine amount.
6. Placing the said memo on record, petition stand
disposed of.
7. The accused who is in custody is ordered to be
released forthwith.
8. The learned Registrar (Judicial) shall issue
necessary intimation to the trial Magistrate forthwith for
issue of release order.
9. In the meantime, an affidavit shall also be filed
by the learned counsel for the petitioner before the
learned trial Magistrate seeking release of the petitioner
pursuant to the order of this Court by filing necessary
application.
