     THIS PETITION, COMING ON FOR ADMISSION, THIS DAY,

ORDER WAS MADE THEREIN AS UNDER:

                         ORAL ORDER

The petitioners are before this Court, seeking the

following prayer:

"(a) quash the proceedings against the petitioners, (accused No.1 and 2) in C.C. No.27248/2024 (crime No.38/2024) cognizance taken under section 498(A), 504, 506 read with Section 34 of Indian Penal Code of the Magadi Road Police Station Bangalore pending on the file of The Court of XXIV Addl. Chief Metropolitan Magistrate at Bangalore.

(b) and pass such other and further order/s or orders as this Hon'ble court may deem fit and proper in the circumstances of the case."

2. Heard Sri. Nizam Abbas, learned counsel appearing

for the petitioners, Sri. Anoop Kumar, learned HCGP appearing

for respondent No.1 and have perused the material on record.

3. Learned counsel appearing for the petitioners

submits that the parties to the lis have settled the dispute

before the Family Court in M.C.No.2062/2024. The terms of

settlement reads as follows:

"MEMORANDUM OF SETTLEMENT UNDER SECTION 89 OF CPC READ WITH RULES 24 AND 25 OF THE KARNATAKA CIVIL PROCEDURE (MEDIATION) RULES, 2005.

I. The Petitioner has filed this petition against the Respondent under Section 13 (1) (i-a) of the Hindu Marriage Act 1955 for dissolution of her marriage with the respondent.

II. The aforesaid petition was referred to mediation for resolving the dispute between the parties. During the course of mediation, the petitioner and the respondent along with their counsels were present in mediation and the parties have resolved their dispute and have agreed to the following terms and conditions:

1. The petitioner and the respondent are Hindus by religion. Their marriage was solemnized on 12.02.2023 at Sri. Chandramouleshwara Bhavana, No.300, S.C Road, Gandhi Nagar, Bengaluru-560 009, as per Hindu rites and customs. Subsequently, the said marriage was registered on 19.09.2023 before the Registrar of Marriage, Basavanagudi, Bengaluru vide certificate No.BSG-HM365-

2023-24 stored in C.D No.BSGM65.

2. The parties state and admit that due to irreconcilable differences and incompatibility of temperaments, they are living separately since 29.11.2023. The efforts made by the elders, friends and well wishers to resolve the differences between the parties did not yield any fruits. There is absolutely no chance of a reunion between them. The petitioner and the respondent know that their marriage is irretrievably broken down and there are no chances of reunion to lead a happy married life. Hence, the petitioner and the respondent have decided to get the marriage dissolved by a decree of divorce.

3. Both the parties state that they have no children born to them from their wedlock.

4. Both parties state and agree that they have no claims of maintenance / permanent alimony against each other either past, present or future.

5. The parties herein state that they have no claims over movable or immovable properties belonging to each other either existing or to be acquired or inherited at a later stage.

6. In view of the above settlement arrived between the parties the petitioner has agreed to withdraw Crl.Misc.No.58/2024 pending before MMTC-VI, Bengaluru on 09.12.2025. Further, the petitioner has undertakes to co-operate and appear the concerned authority/court for the closure/quashing of C.C No.27248/2024 filed under Section 498-A of IPC which is pending before 24h ACMM, Bengaluru.

7. The parties state that they have already exchanged their valuables articles and as such there are no dues in this regard.

8. The parties admit and agree that they have no further claims of whatsoever manner against each other either past, present or future.

9. The parties admit and agree that there is no collusion or force, fraud or any undue influence in filing the above petition and entering into this compromise in the aforesaid manner.

10. Both the parties admit that they shall not interfere in the lives of each other in future.

11. The petitioner and the respondent have agreed to delete the messages/photos/audio/videos/recordings of each other which are in their possession and indemnify other's privacy. Both parties herein indemnify each other that they shall restrain

themselves from making any statements/ allegation against each other in any public/social forum/platform.

12. Both parties have agreed to withdraw all the allegations made against each other.

III. In view of the aforesaid agreement entered into between the parties, the parties pray that this Hon'ble Court be pleased to dissolve the marriage solemnized on 12.02.2023 at Sri. Chandramouleshwara Bhavana, No.300, S.C Road, Gandhi Nagar, Bengaluru-560 009 and cancel the marriage certificate registered on 19.09.2023 before the Registrar of Marriage, Basavanagudi, Bengaluru vide certificate No.BSG-HM365-2023-24 stored in C.D No.BSGM65 by granting a decree of divorce in terms of this agreement.

IV. Parties will appear on 08.12.2025 before the Hon'ble Court for passing of orders in terms of the agreement."

4. In the light of the settlement arrived at between the

parties and offences not being against the State, I deem it

appropriate to accept the same and terminate the proceedings

against these petitioners in the subject petition.

5. For the aforesaid reasons, the following:

ORDER

i. Criminal Petition is disposed. ii. Proceedings in C.C.No.27248/2024 pending before the XXIV Additional Chief Metropolitan
