                      ORAL ORDER

The counsel for the petitioner is absent and the

counsel for the respondent is present.

This matter is listed for settlement. Inspite of time

was taken for settlement, the counsel for the petitioner

failed to appear before the Court. The counsel for the

respondent submits that when the application was filed to

bring the legal representatives of the deceased respondent

on record, the said application was allowed but the counsel

for the petitioner has not carried out the amendment.

However, with the permission of the Court, counsel for the

respondent has carried out the amendment. Hence, it

appears that the counsel for the petitioner is not

interested in pursuing the matter diligently. Thus, there is

no ground to adjourn the matter. Accordingly, the petition

is dismissed for non-prosecution.
