       THIS PETITION COMING ON FOR PRELIMINARY HEARING
IN 'B' GROUP, THIS DAY, THE COURT MADE THE FOLLOWING:

                                ORDER

Heard learned counsel Sri Prakash M. Patil appearing for

the petitioner.

2. The learned counsel for the petitioner has filed a

memo dated 09-01-2023, seeking to withdraw the petition.

The same is placed on record.

3. The memo reads as below:

"The petitioner submits as under:

The petitioner has challenged the order dated 09.08.2019 passed on I.A No.14 in M.C. No.751 of 2013. Now the above M.C No.751 was disposed off on merits on 14.11.2019 against which the petitioner has the judgment and decree passed in M.C.No.751/2013 by filing MFA before this Hon'ble Court which is pending for consideration. Hence the petition does not survive for consideration.

Wherefore the petitioner prays that this Hon'ble court be pleased to permit the petitioner to withdraw the above petition in the interest of justice and equity."
