Learned counsel for the petitioner has filed a

memo stating that the petition does not survive for

consideration since the petitioner-accused has been

convicted for the offences alleged against him and

appeal is filed against the judgment of conviction.

2. Memo is placed on record.

3. Accordingly, petition is dismissed as having

become infructuous.

It is needless to state that the petitioner-accused

is at liberty to raise all the contentions that are

available in law before the Appellate Court in pending

appeal.
