      This MSA is filed under Section 54(2) of the Land
Acquisition Act, praying to allow this appeal with costs and
award Rs.51,400/- per acre with all statutory benefits by
modifying the judgment and award dated 01.08.2007
passed in LACA No.91/2007 by the II Addl. District Judge,
Gulbarga and also the common judgment and award dated
20.12.1995 passed by the Addl. Civil Judge, Gulbarga in
LAC No.75/1994 vide Annexure-D and etc.

      This appeal coming on for Final Hearing, this day,
the Court delivered the following:-

                      JUDGMENT

Learned counsel for the appellant submits that

the sole appellant has died eight months back. He also

submits that he will take necessary steps. Since the

sole appellant died long back, the appeal stands

abated.

The legal representatives of appellant are at

liberty to move the application.
