       This Regular Second Appeal is filed under Section 100
of CPC, praying to allow the regular second appeal and
thereby please to set aside the judgment and decree passed
in R.A.No.05.2016 on the file of Addl. Senior Civil Judge,
Bidar dated 23.01.2017 and dismiss the suit of the
respondent plaintiff in O.S.No.193/2011 on the file of Prl.
Civil Judge & JMFC-II, Bidar dated 21.01.2016 and thereby
confirm the dismissal of suit by trial Court along with costs.

      This appeal coming on for Admission this day, the
Court delivered the following:

                         JUDGMENT

It is submitted that the sole appellant has expired

about two years back and the affidavit of respondent is

also filed. At this juncture, no steps were taken. Hence,

the appeal stands abated.
