02/17.03.2026 Heard learned counsel appearing for the petitioners as well

as the learned counsel appearing for the State.

2. The petitioners are apprehending their arrest in connection

with Complaint Case No.1702 of 2021, for the alleged offences

registered under Sections 42 of Indian Forest Act and Section 51(1)

of Wild Life Protection Act, 1972 pending in the Court of learned

Chief Judicial Magistrate, Koderma.

3. Learned counsel appearing for the petitioners submits that

the petitioners have been falsely implicated in the case and false

allegations are made of excavating mica scrap. He further submits

that the petitioners are earning their livelihood by way of doing

labour work. He then submits that one of the co-accused person

has already been granted anticipatory bail by Co-ordinate Bench of

this Court in ABA No.11482 of 2022 and two of the co-accused

persons have already been granted anticipatory bail in ABA No.60 of

2026. He then submits that the petitioners have got no criminal

antecedent as disclosed in paragraph No.10 of the petition.

4. Learned counsel appearing for the State opposed the prayer

and submits that the allegations are there against the petitioners of

doing theft of mica scrap.

5. Considering that the petitioners are said to be labourer and

they earn their livelihood by way of doing the said work and the

petitioners have got no criminal antecedent as disclosed in

paragraph No.10 of the petition and three of the co-accused

persons have already been granted anticipatory bail in the aforesaid

ABAs and in that view of the matter the petitioners are directed to

surrender before the learned Court within two weeks and the

learned Court shall release the petitioners on such terms and

conditions or the sureties as the learned Court may deem fit and

proper.
