1. Heard Mr. Anil Kumar Singh, learned counsel for the appellants,

Mr. V. P. Singh, learned senior Advocate appearing on behalf of

respondent Nos. 3 and 4, Mr. Sahbaj Akhtar, learned A.C. to A.A.G.-III

appears for respondent Nos. 1, 2, 5, 6 & 7 and Mr. S. P.

Roy, learned counsel appearing for respondent Nos. 9 and 10.

2. Mr. Singh submits that the learned Single Judge, by the

impugned order, should not have dismissed the petition even without

requiring the respondents to file a counter. On instructions he maintains

that the appellants continuing possession of the acquired land.

3. Leaving open all contentions of the respondents, we direct the

concerned respondents to file their counters in this matter, responding

to the allegations in the main petition, latest by 10th April, 2026.

4. This position is disputed by learned counsel for respondent Nos.3

and 4. He states that the acquired property has already been allotted to

some entrepreneurs.

5. Advance copy should be served upon the learned counsel for the

appellants.

6. If the appellants wish to file a rejoinder, they should file and serve

the same latest by 17th April, 2026.

7. Place this matter on 20th April, 2026 high on board.
