15 /05.02.2026: Due to dispute in respect of genealogy the petitioner has not been given compassionate appointment.
2. The petitioner claims to be the wife of the deceased employee, namely, Naresh Oraon who died in harness. Learned counsel for the petitioner submits that one month before the death of the deceased employee the marriage was solemnised with the petitioner thus, the name of this petitioner is not there in any of the service records, further, it is submitted that the father and mother of the deceased employee, namely, Naresh Oraon acknowledges this petitioner as their the daughter-in-law.

When the father and mother of the deceased employee accepts and has given statement before the Central Coalfields Limited that this petitioner is the daughter-in-law, the Central Coalfields Limited has got no authority or jurisdiction to dispute the relationship. This is novel way to deprive the widow from her claim of compassionate appointment.
4. It is also brought to the notice of this Court that there is Dispute Resolution Committee, but the said Committee has also got no role, on the facts of the instant case, as infact there is no dispute at all in respect of genealogy of the deceased.
5. Learned counsel for the respondents submits that it is the State who is disputing the genealogy as the State says that original
register is missing. In this case the relationship between the parties can be doubted by the members of the family. This is a case where compassionate appointment has been sought by the wife of the deceased.
6. In view of the facts of this case, I direct the respondents to consider this petitioner to be legally wedded wife of the deceased in view of the statement given by the father-in-law and mother-in-law of this petitioner, i.e. the parents of the deceased employee and proceed accordingly and pass a final order in respect of compassionate appointment of this petitioner.
7. List this case on 12.02.2026 for compliance.
8. Let a copy of this order be given to Dr.(Mrs.). Vandana Singh, the learned counsel for the respondents.
