06/18.02.2026     Learned counsel appearing for the petitioner submits that I.A.

No.17105 of 2025 has been filed for suspension of sentence. He further

submits that the matter is arising under Section 138 of the Negotiable

Instrument Act. He then submits that the petitioner has been sentenced to

undergo S.I. for one year and also to pay fine of Rs.11,40,000/- by way of

compensation to the complainant and in case of default, he has been further

sentenced to undergo S.I. for three months vide judgment of conviction and

order of sentence dated 22.02.2025 passed by the learned Judicial Magistrate,

1st Class-XXX, Ranchi in Complaint Case No.2291 of 2023. He submits that

the petitioner has challenged the said judgment by filing Criminal Appeal

No.98 of 2025, which was dismissed by the learned Judicial Commissioner,

Ranchi vide judgment dated 13.08.2025 and the judgment of the trial court

has been affirmed. He next submits that now both the sides have

compromised the matter and sum of Rs.1,50,000/- has already been paid to

the opposite party no.2/complainant. He submits that the compromise

petition has been filed in the form of I.A. No.1828 of 2026. He also submits

that two post-dated cheques have been prepared in the name of opposite

-1- Criminal Revision No. 1231 of 2025 party no.2/complainant for payment of remaining amount, i.e. cheque dated

27.02.2026 amounting to Rs.1,50,000/- and cheque dated 06.11.2026

amounting to Rs.8,40,000/- contained at pages 15 and 16 of I.A. No.1828 of

2026. He further submits that the petitioner is in custody since 09.12.2025.

2. Learned counsel appearing for opposite party no.2/complainant

submits that opposite party no.2 has already received the amount of

Rs.1,50,000/-, however, the said post-dated cheques are of February, 2026

and November, 2026 respectively and there is possibility that the said cheques

may not be encashed. He submits that in view of that, this matter may kindly

be further taken after 06.11.2026.

3. In view of the above and considering that compromise has reached

between the parties and the petitioner has already paid the amount of

Rs.1,50,000/- to the opposite party no.2/complainant and two post-dated

cheques have also been prepared in the name of complainant for payment of

remaining amount and, as such, during the pendency of this criminal revision

petition, the sentence awarded to the petitioner is, hereby, suspended and

the petitioner is directed to be released on bail on furnishing bail bond of

Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like

amount each to the satisfaction of the Judicial Magistrate, 1 st Class-XXX,

Ranchi in connection with Complaint Case N.2291 of 2023.

4. Accordingly, I.A. No.17105 of 2025 is allowed and disposed of.

5. Let this matter appear under the heading for 'Orders' on 23.11.2026.
