07/16.10.2025 Call for a report from the learned Court below regarding amount of compensation paid by the learned DLSA, Daltonganj pursuant to the judgment passed by the learned Court below.

2. Learned counsel for the appellants has submitted that the informant had taken time to file counter-affidavit on 26.09.2025 but till date no counter-affidavit has been filed.

3. This Criminal Appeal has been filed by the appellants by challenging the judgment of conviction and sentence dated 12.06.2025 passed by Sri Shankar Kumar Maharaj, learned Additional Sessions Judge-III, Palamau at Daltonganj in Sessions Trial No. 67 of 2017 arising out of Nawa Jaipur P. S. Case No. 33 of 2016 correspondent to G. R. Case No. 2090 of 2017 by which the appellants have been convicted for the offences under Sections 148, 504/34 and 324/34 of the Indian Penal Code and sentenced to

undergo R. I. for a period of two (2) years for the offence under Section 148 of the Indian Penal Code and sentenced to undergo R.I. for a period of three (3) years and to pay the fine of Rs. 5,000/- each for the offence under Sections 324/149 of the Indian Penal Code and also sentenced to undergo R.I. for two years for the offence under Section 504 of the Indian Penal Code.

However, all the sentences have been directed to run concurrently.

4. I. A. (Cr.) No. 10267 of 2025 has been filed under Section 430 (1) of the BNSS, 2023 on behalf of the appellants for confirmation of Provisional Bail granted by the learned Court below on 12.06.2025 for a period of thirty (30) days and which was extended by this Court vide order dated 05.08.2025, 08.09.2025 and 26.09.2025 respectively.

5. Under the circumstances, provisional bail granted to the appellants by the learned Additional Sessions Judge-III, Palamau at Daltonganj in connection with S.T. No. 67 of 2017 is hereby confirmed.

6. Thus, I. A. (Cr.) No.10267 of 2025 is allowed and stands disposed of.

7. Admit.

8. Office is directed to issue notice to Respondent No.2.

9. Call for the scanned copy of the Lower Court Records.
