The petitioner in this writ petition has prayed for the
following reliefs:-
"i) For direction upon the respondents to give appointment to the petitioner on compassionate ground in view of the fact that his father who was appointed to the post of "Cable Man" under the respondents, is missing since 2008 and under the law it will be presumed that he is no more and due to his missing the entire family is in deep financial crunch as he was the sole bread earner of the family.
ii) For direction upon the respondents to make payment of death-cum-retiral benefits of his father, along with statutory interest to the petitioner and his family members."
2. Heard learned counsel representing the petitioner and
learned counsel representing the respondents.

3. It is the case of the petitioner that his father, who was a
"Cable Man" under the respondent - CCL, went missing in the year
2008, thus the petitioner is entitled for compassionate appointment
and also for grant of other death-cum-retiral benefits.
4. During the course of argument, it has been fairly
submitted by learned counsel representing the petitioner that a suit
being Civil (Title) Suit No.48 of 2015 seeking declaration in terms of
Section 108 of the Indian Evidence Act, is pending before the Civil
Judge, Junior Division, Hazaribagh, for defence evidence.
5. Admittedly, the employee went missing since 01.04.2008.
Seventeen years have already lapsed. The family has survived the
immediate financial crisis. Thus, there is no ground for giving
compassionate appointment.
5.1. Further, as on date, there is no declaration of civil death.
The issue is still pending before the appropriate Civil Court. Once the
judgment is passed by the appropriate Civil Court, the petitioner
should approach the Authority for claiming the death-cum-retiral
benefits.
6. With the aforesaid observations, this writ petition stands
disposed of.
