02/09.06.2025 Learned counsel for the Appellant is directed to implead the guardian of the Victim Girl as Respondent No.2 in this case during course of the day.

2. Learned counsel for the appellant submitted that this case has been already mentioned during summer vacation and the Bench Slip was also allowed by this Court by fixing the case on 22.05.2025, but still the case was not placed during vacation before this Court on the date fixed.

3. Call for an explanation from the Section Officer and Dealing Assistant of the concerned Section for not placing this case on 22.05.2025 although the Bench Slip was allowed.

4. Admit.

5. Learned A.P.P. is directed to get served the Notice of this Criminal Appeal upon the guardian of the Victim girl through the Superintendent of Police,

Koderma in the light of the judgment of the Hon'ble Supreme Court in the case of "Nipun Saxena and another v. Union of India and others" reported in (2019) 2 Supreme Court Cases 703 and Notification No. 23/2023/R&S/JHC dated 20.12.2023 of the Jharkhand High Court and shall file counter affidavit with regard to service of Notice on the guardian of the Victim Girl.

6. Call for the legible scanned copies of the Lower Court Record.

7. Prayer for bail of the Appellant will be considered after receipt of the Lower Court Record.

8. Let a copy of this order be sent to the office of the Superintendent of Police, Koderma by Fax and also be handed over to the learned A.P.P. for the needful.

9. Put up this case on 7th July, 2025 under the heading 'For orders' on receipt of the L.C.R.
