2. This is an application filed by the petitioner praying for grant of anticipatory bail under Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending his arrest for the offences under Section 406/420 of IPC in connection with Namkum P.S. Case No.351 of 2024, pending in the Court of learned Judicial Magistrate, Ranchi.

3. The allegation in the F.I.R. is that the informant has paid Rs.5 lakhs and odd to the petitioner to purchase the land, but petitioner did not sell the same. It is alleged that when the informant visited the land for construction work, the informant was prohibited and informant came to know that the petitioner has cheated may persons by executing sale agreement of the said land.

4. In this case, I find that notice under Section 41-A of Cr.P.C. has been issued to the petitioner, which is apparent from the impugned order, but the petitioner has not appeared. Issuance of notice under Section 41-A of Cr.P.C. suggest that the police does not want to arrest the petitioner.

5. Thus, I direct the petitioner to appear before the Investigating Officer.

6. In the meantime, if petitioner appears before the Court concerned, his case will be considered, in terms of the judgment passed by the Hon'ble Supreme Court.

7. It is made clear that the petitioner will mark his attendance before the I.O. once in every 15 days till filing of the chargesheet.

8. Accordingly, the instant anticipatory bail application stands disposed of.
