Mr. R.S. Mazumdar, the learned senior counsel appearing for the respondent has sought leave of this Court to allow him to accept the counter-affidavit.
2. Such leave is being granted taking into consideration the fact that the copy of the same has been served to Mr. Amit Kumar Das, the learned counsel appearing for the petitioner-Directorate of Enforcement.
3. Let the same be kept on record.
4. An order passed on 07.01.2025 in Special Leave to Appeal (Crl.) No(s). 197 of 2025 by the Hon'ble Apex Court is available on record. It appears from the said order that the concerned respondent, namely, Alok Ranjan has preferred a Special Leave Petition against the order dated 13.12.2024. The Hon'ble Apex Court has been pleased to dispose of the said application with a permission to the petitioner to apply for vacating the interim order which is to be decided in accordance with law.
5. Mr. R.S. Mazumdar, the learned senior counsel assisted by Mr. Nishant Kumar Roy, the learned counsel appears for the Opposite Party No.2 and Mr. Rahul Kumar, the learned counsel appears for the Opposite Party No.3 have jointly submitted that no such application has been filed rather they have submitted that the matter may be decided on merit finally since the counter-affidavit has already been filed in the case.
6. This Court taking into consideration the aforesaid submission made on behalf of the learned counsel appearing for the concerned opposite parties the issue is being decided finally on merit since the pleadings are complete.
7. Heard the learned counsel appearing for the parties.
