06 / 14.02.2025 This interlocutory application has been filed for suspension of sentence and grant of bail to the appellant during the pendency of this appeal.

2. The appellant has been held guilty for the offences under sections 395 and 412 of the Indian Penal Code vide judgment of conviction dated 09.08.2024 passed by Shri Paras Kumar Sinha, learned Additional Sessions Judge-VIII, Dhanbad in Sessons Trial No. 101 of 2012 arising out of Dhanbad P.S. Case No. 517 of 2011 and vide order of sentence dated 16.08.2024, he was sentenced to undergo R.I for seven years along with a fine of Rs. 10,000/- for the offence under section 395 of the Indian Penal Code. In default of payment of fine, he was directed to undergo S.I for six months. He was further sentenced to undergo R.I five years along with a fine of Rs. 10,000/- for the offence under section 412 of the Indian Penal Code. In default of payment of fine, he was further directed to undergo S.I for six months. Both the sentences were ordered to run concurrently.

3. Learned counsel for the appellant submitted that the appellant has remained in custody more than five years. It was further submitted that there is no likelihood of this criminal appeal to be taken up for hearing in the near future.

4. Mr. Nawin Kumar Singh, learned A.P.P has confirmed that the appellant has remained in custody for more than five years.

5. In view of the aforesaid facts, during the pendency of this appeal, appellant, above named, is directed to be released on bail on furnishing

bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of Shri Paras Kumar Sinha, learned Additional Sessions Judge-VIII, Dhanbad in connection with Sessons Trial No. 101 of 2012 arising out of Dhanbad P.S. Case No. 517 of 2011.

6. The aforesaid I.A. stands disposed of accordingly.
