1. Heard the learned counsel for the appellant.

2. The learned counsel for the appellant has submitted that the appellant is only aggrieved by the allocation of "Jethans" to the eldest brother namely Sakhi Singh which was in relation to Plot No. 31, Area 1.18 decimals.

3. The learned counsel has relied upon the judgment passed by the Hon'ble Supreme court reported in AIR 1968 SC 1299 paragraph 6 and has submitted that it has been held that the concept of "Jethansi" is now obsolete and un-enforceable.

4. The learned counsel submits that this second appeal be heard on the point as to whether "Jethans" could have been allocated to the elder brother namely Sakhi Singh in family partition which happens in the year 1940.

5. Arguments concluded on the point of framing substantial question of law.

6. Post this case on 17th February, 2025 for orders.
