1. The instant interlocutory application has been filed on behalf of the appellant for suspension of sentence and grant of ad interim bail, during pendency of the instant appeal.

The present appeal has been preferred against the judgment of conviction dated 10.08.2023 and order of sentence dated 11.08.2023, passed by the court of Special Judge, POCSO Act, Dhanbad in Special (POCSO) Case No.144 of 2020 arising out of Saraidhela P.S. Case No.225 of 2020, whereby the appellant has been convicted for the offence under Section 10 of the POCSO Act and sentenced him to undergo rigorous imprisonment for six years and to pay a fine of Rs.5,000/-, with default clause.

3. It appears that earlier the applicant has preferred the interlocutory applications being I.A. No.6303 of 2024 and I.A. No.12665 of 2024 which have been dismissed as withdrawn. This is the third attempt.

4. Learned counsel for the appellant has submitted that the appellant is an old aged person and he has suffered incarceration for the period of two years and four months. It has been further submitted that there is dispute between the parties and both are on litigating terms. On this ground, prayer for suspension of sentence has been made.

5. Learned A.P.P. has opposed the prayer for bail of the appellant and submitted that the bail of the applicant has already rejected twice time.

6. Considering the period of custody and the age of the appellant, I am inclined to suspend the sentence and enlarge the appellant on bail, on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Act, Dhanbad in Special (POCSO) Case No.144 of 2020 arising out of Saraidhela P.S. Case No.225 of 2020, subject to the condition that the appellant will remain present before the Court when the appeal is taken up for hearing, failing which his bail shall be cancelled.

7. I.A. No.9441 of 2025 stands disposed of.
