02/26.09.2024 Learned counsel for the petitioner submits that the

present case is squarely covered by the judgment rendered by a

Bench of this Court in the case of "Vinod Shankar Jha Vs. State of

Jharkhand & Ors." and other analogous cases, reported in 2024

SCC OnLine Jhar 243.

2. Issue notice.

3. Mr. Ravi Prakash Mishra, AC to AAG-II, appears and

waives notice on behalf of the respondent no. 2. He prays for and is

allowed four week's time to seek instruction and file counter affidavit.

4. Issue notice to the respondent no. 3 through speed post

for which requisites etc. must be filed by 01.10.2024.

5. Put up this case under appropriate heading on

14.11.2024.

6. Till then, the further proceeding arising out of Misc. Case

No. 02/2016 pending before the respondent no. 2 - the Deputy

Commissioner, Hazaribagh shall remain stayed.
