05 /24.09.2024: I.A. No.7330 of 2024 This interlocutory application has been filed by the appellant praying therein to suspend the sentence and release him on bail during the pendency of this appeal.

2. The appellant has been convicted for the offence under Section 302 of IPC, in connection with S.T. Case No.250(A) of 2006. He has been sentenced to undergo rigorous imprisonment for life with a fine of Rs.30,000/-, for the offence under Section 302 of IPC.

3. Heard, learned counsel for the appellant and learned A.P.P. for the State and have gone through the impugned judgment, the evidence and the Trial Court Records.

4. Opportunity was given to the State to oppose the bail, which the State availed and opposed.

5. There is direct allegation against this appellant of committing murder. The witnesses have supported the case. Further, appeal of co-convict have already been dismissed by Co-ordinate Bench of this Court in Cr. Appeal (D.B.) No.202 of 2011 with Cr. Appeal (D.B.) No.477 of 2011 vide order dated 11.04.2018. The informant was so terrorized that before the Trial Court, she deposed that this appellant and other have committed the murder of his mother and father and if she depose, they will commit murder of her husband. Thus, she did not make any statement on the fact before the Trial Court. Thus, her examination was deferred, though later she deposed.

6. Considering the aforesaid fact, we are not inclined to release the appellant on bail.

7. Accordingly, I.A. No.7330 of 2024 stands dismissed.
