02/02.05.2024 The matter relates to Sindri P.S. Case No.108/2023, pending in the

Court of the learned Judicial Magistrate, 1st Class, Dhanbad.

2. After some arguments, learned counsel for the petitioner seeks

permission to withdraw this application with liberty to move before the

learned Court by way of filing appropriate petition on the strength of the

judgment passed by the Hon'ble Supreme Court in the case of the

Satender Kumar Antil v. Central Bureau of Investigation and

another, reported in (2022) 10 SCC 51.

3. Learned counsel for the State and opposite party no.2 have got

no objection.

4. Accordingly, this application is dismissed as withdrawn with the

aforesaid liberty.
