The present writ petition has been filed for quashing

the final merit list (Anneuxre-4 to the writ petition) published for

appointment on the post of Trained Graduate Teacher (TGT)

pursuant to Advertisement No. 21 of 2016 as, according to the

petitioner, he was not considered for appointment on the said

post despite having all the requisite qualifications.

2. The writ petition was earlier taken up on 23.02.2024

and on the said date, learned counsel for the respondent-

Jharkhand Staff Selection Commission (JSSC) was directed to

apprise this Court as to whether the petitioner had come in the

zone of consideration for appointment in the concerned subject

after preparation of State-wise merit list in terms with the

judgment rendered by the Hon'ble Supreme Court in the case of

"Satyajit Kumar & Ors. Vs. State of Jharkhand & Ors.",

reported in 2022 SCC OnLine SC 954 read with the orders

passed by the Hon'ble Supreme Court in Contempt Petition

(Civil) No. 612 of 2022 (Soni Kumari Vs. K. Ravi Kumar).

3. Today, learned counsel for the respondent-JSSC, on

instruction, submits that the petitioner had applied on the post

of TGT in subject- 'Bangla' under 'Unreserved' category. He,

after appearing in the written examination, obtained 230 marks

whereas the last selected candidate as per State-wise merit list

prepared by JSCC in terms with the aforesaid judgment/orders

passed by the Hon'ble Supreme Court, has obtained 262 marks.

Under the said circumstance, the petitioner has not been

recommended for appointment to the post of TGT in the said

subject.

4. Considering the said factual submission made by

learned counsel for the respondent-JSSC, this Court is of the

view that the petitioner has failed to make out any case for

being appointed as TGT in the concerned subject.

5. The writ petition being devoid of merit is accordingly

dismissed.
