08/05.02.2024 All these contempt applications are being taken up together for
consideration with the consent of learned counsel for the parties.
All these contempt applications have been filed against the concerned
opposite parties alleging wilful disobedience and non-compliance of the
judgment dated 05.09.2018 passed by this Court in batch of writ petitions led by
W.P.(S) No. 921/2011 [Bal Mohan Prasad & Ors. Vs. State of Jharkhand & Ors.].
Learned counsel for the concerned opposite parties of the present batch
of contempt applications submit that the judgment dated 05.09.2018 passed by
this Court in batch of writ petitions led by W.P.(S) No. 921/2011 was challenged
by the State of Jharkhand by preferring batch of L.P.As led by L.P.A. No.
138/2019 (State of Jharkhand & Ors. Vs. Bal Mohan Prasad & Ors.). The said
L.P.As were finally allowed by learned Division Bench of this Court vide
judgment dated 19.01.2024, except the cases which have been mentioned in
paragraph 32 of the said judgment and the present petitioners do not come
under the purview of the said paragraph.
Having heard learned counsel for the parties and considering that L.P.A.
No. 138/2019 preferred by the State of Jharkhand challenging the judgment
dated 05.09.2018 passed by the writ Court in batch of writ petitions led by
W.P.(S) No. 921/2011, have been allowed by learned Division Bench, this Court
is of the view that no case of contempt is made out against the concerned
opposite parties.
The contempt proceeding against the concerned opposite parties is
hereby dropped.
All these contempt applications stand disposed of.
