This interlocutory application has been filed by the appellant praying therein to suspend the sentence and release him on bail during pendency of this appeal.

2. The appellant has been convicted and sentenced in connection with S.T. Case No. 500 of 2019 for the offence under Sections 376(D), 506 and 323 of the Indian Penal Code. He has been sentenced to undergo RI for 20 years for the offence under Section 376(D) of the IPC along with Fine of Rs.25,000/- amongst other sentences.

3. Heard the learned counsel for the appellant and learned APP for the State and have gone through the impugned judgment, the evidence and the Trial Court Records.

4. Opportunity was given to the State to oppose the bail, which the State availed and opposed.

5. There is a direct allegation against this appellant of committing rape upon the victim. P.W.-1 Prakash Lakra, who was also present has supported the prosecution case. Further one of the co-convict Raju Sharma has already been denied privilege of bail.

6. Considering the aforesaid fact, we are not inclined to allow this interlocutory application.

7. Accordingly, this interlocutory application stands dismissed.
