1. The instant Interlocutory Application has been preferred to keep the sentence in abeyance during pendency of this Criminal Revision and release the petitioner on bail.

2. Learned counsel for the petitioner has submitted that the petitioner has surrendered before the Court below on 13.09.2023. It has been further submitted that the divorce has also been granted vide order dated 30.01.2018 passed by the learned Principal Judge, Family Court, Palamau at Daltonganj in Matrimonial Case No.36 of 2013. In view of the above, contended to keep the sentence in abeyance and release the petitioner on bail.

3. Learned Spl. PP appearing on behalf of the State opposed the contentions made by the learned counsel for the petitioner.

4. In view of the submissions made by the learned counsel for the petitioner, I.A. No. 9456 of 2023 is hereby allowed. The impugned judgment of conviction and sentence passed by the learned trial Court, which was affirmed by the learned appellate Court are hereby kept in abeyance.

5. In consequence thereof, the petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty-Five Thousand) with two sureties of the like amount to the satisfaction of the court concerned. Cr. Revision No. 342 of 2023

6. Admit.

7. Let notice be issued to the opposite party No.2 through the police station concerned.

8. Learned counsel for the State is directed to ensure the service of notice to opposite party No.2 and file affidavit on or before date fixed.

9. List this case on 18.12.2023.
