4/03.02.2023 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf O.P. No.2. Learned APP is also present on behalf of the State.

The office has pointed out some defects including the limitation petition has not been filed, the surrender certificate has also not been filed and there are some correction in the certified copy of the impugned judgment of trial court, in which some correction has been made.

It has been pointed out by learned counsel appearing on behalf of the petitioner that it is a case under section 138 of the N.I. Act and both the parties have resolved their dispute and a joint compromise petition has also been filed vide I.A. No. 8302 of 2022, which has been sworn on affidavit by the petitioner Kamaljeet Kaur and opposite party No. 2 compliant Jayesh Ashok Thankey. It has also been submitted on behalf of the petitioner that process under sections 82 and 83 of Cr.P.C. have been issued against this petitioner, although to that effect no authenticated order has been filed on behalf of the petitioner. Further learned counsel submitted that let this case be adjourned in order to facilitate the petitioner to file the limitation petition with a prayer that in the meantime, the interim order of relief be granted to the petitioner.

Learned counsel appearing on behalf of opposite party No. 2 does not raise any objection in granting the petitioner interim relief from any coercive measures.

In view of the submission advanced on behalf of both the parties, let this case be posted on 9th February 2023 and in the meantime no coercive steps shall be taken against the petitioner in connection with C/1 Case No.210 of 2013 (T.R. No.211 /2018).
