Heard learned counsel for the appellant.
Learned counsel for the appellant has argued that the
appellant has remained in custody for about 13 years, hence, he
has already undergone more than the minimum sentence as
provided under the provision of Section 304-B of the Indian
Penal Code. In order to substantiate his argument, learned
counsel has relied upon the judgment rendered by Hon'ble Apex
Court in the case of State of Madhya Pradesh v. Jogendra
and Another reported in (2022) 5 SCC 401.
Mr. Manoj Kumar Mishra, learned Additional Public
Prosecutor, has sought for time to address the Court on the
issue of merit and to respond the argument advanced on behalf
of the appellant on the point of sentence.
As prayed for by learned counsel for the State, list this
matter on 06.09.2023.
