The instant Interlocutory Application has been preferred on behalf of the petitioner for condonation of delay of 79 days in preferring the instant Criminal Revision.

The ground shown that the impugned order was ex-parte and he came to know in regard to this order in the month of May, 2022 and applied for certified copy of the judgment, which was issued on 12.07.2022 and under the impression that it could be preferred under 90 days, therefore, there is delay in preferring this Criminal Revision.

The ground shown for delay in preferring the instant Criminal Revision is found sufficient, accordingly, delay of 79 days in preferring the instant Criminal Revision is condoned.

Accordingly, I.A. No. 11257 of 2022 stands disposed of. Cr. Revision No. 975 of 2022 This Criminal Revision has been preferred on behalf of the petitioner against the order dated 16.03.2020 passed by the learned Principal Judge, Family Court, Dhanbad in Original Maintenance Case No.307 of 2019, whereby the petitioner has been directed to pay the amount of maintenance of Rs. 4000/- per month to the opposite party.

Admit.

Let notice be issued upon the opposite party through registered cover with A/D as well as ordinary process, for which, requisites etc. must be filed by the petitioner within seven days.

Office is directed to call for the scanned copy of the Lower Court Records. List this case for hearing on 21.09.2023.
