This matter is listed under 'To Be Mentioned' category. It was
heard by us on 05.04.2023, but during preparation of the judgment,
certain questions regarding the powers of the Court to take suo motu
cognizance arose an application filed by the petitioner which required
further hearing. The matter was reserved on the question of
maintainability of the Public Interest Litigation on being mentioned in
I.A. No. 3174 of 2023 which was filed for dismissal of the instant
Public Interest Litigation.
It is also brought to our notice that Mr. Kapil Sibal, learned
Senior Counsel, who has to argue in the case, is at present arguing
the case before the Constitution Bench of Hon'ble Supreme Court of
India and the learned counsel for the respondents prays for an
adjournment.
Thus, it is released from the part-heard, but it will be listed on
14.09.2023 under the same heading at the top of the list.
