The petitioner Anand Prabhakaran has filed this revision application challenging the order of acquittal dated 12.06.2015 passed by Sri Nikesh Kumar Sinha, learned Additional Sessions Judge-II, Jamshedpur in connection with C/1-1822 of 2008, whereby and wherein the learned Additional Sessions Judge-II, Jamshedpur allowed the appeal of the opposite parties Nos.2 and 3 by setting aside the judgment of conviction and order of sentence passed by Sri Nirupam Kumar, learned Judicial Magistrate, 1st Class, Jamshedpur in aforesaid case, held the petitioner guilty of offences under Sections 420 and 120B of the Indian Penal Code.
In light of the decision of Hon'ble Supreme Court in Joseph Stephen and Others Vs. Santhanasamy and Others, reported in 2022 SCC Online SC 90, Criminal revision will not be maintainable before this Court, rather criminal appeal will be maintainable.
Learned counsel appearing on behalf of the petitioner is directed to make necessary amendment in this revision application and convert the criminal revision application into criminal appeal.
Office is directed to list this case before the appropriate Bench after fresh stamp reporting.
