08/17.04.2023     Heard the learned counsel for the petitioner.

Nobody appears on behalf of the respondents. Learned counsel for the petitioner submits that the surviving grievance of the petitioner is only in relation to the period 2003-2004, 2006- 2007 and 2007-2008.

2. So far as petition for 2003-2004 is concerned, the application was delayed by 1 year 4 months and 5 days; for the period 2006-2007, it was delayed by 70 days and for the period 2007-2008, it was delayed by 30 days.

3. Learned counsel for the petitioner has submitted that although the order of remand is a limited remand, but so far as the judgment passed by Hon'ble Division Bench in LPA No.211 of 2012 (State of Jharkhand and Ors. Vs. Bir Steel Private Limited) dated 13.06.2018 is concerned, the same has been referred to larger Bench for consideration.
