It appears from the impugned judgment that the maximum sentence inflicted upon the appellant is for the period of seven years as would appear from the sentence dated 06.12.2022 wherein rigorous imprisonment for five years under Section 363 of I.P.C.; rigorous imprisonment for seven years under Section 366 of I.P.C.; rigorous imprisonment for three years under Section 354 of IP.C. and; rigorous imprisonment for four years under Section 8 of the POCSO Act, have been inflicted.
The Office is to explain as to why the instant matter has been placed before the Division Bench.
List this matter with the aforesaid report/explanation on 12.04.2023.
