03/Dated: 08/03/2022 Mr. S.L. Agarwal, learned counsel for the petitioners submits that
F.I.R. is barred under section 610 of the Jharkhand Municipal Act, 2011 and only on
the basis of complaint, criminal case can be initiated for which this petition has been
filed. He relied on judgment in the case of "Ballabhdas Agarwala Vs. J.C. Chkravarty"
reported in AIR 1960 SC 576.
Respondent no. 2 shall file counter-affidavit within four weeks.
Till then, no coercive step shall be taken against the petitioners in
connection with Bistupur P.S. Case No. 18 of 2021, corresponding to G.R. Case No.
1539 of 2021, pending in the Court of learned Chief Judicial Magistrate, Jamshedpur.
Post the matter on 13.06.2022.
