Order No. 03: Dated: 07th June, 2022 Mr. Anoop Kr. Meha, learned counsel appearing on behalf of the petitioners submitted that the award has been implemented and therefore the order taking cognizance for the offence punishable under Section 29 of the Industrial Disputes Act does not hold good.

Mr. Madan Prasad, learned central government counsel appearing on behalf of the opposite party no.2 seeks adjournment to file counter affidavit in this case.

Accordingly, this case is adjourned with a direction to the learned Central Government Counsel to file a counter affidavit by the next date positively.

In the meantime, let status report be called for from the concerned Court regarding the status of the case in the light of the judgment passed by the Hon'ble Supreme Court in the case of Asian Resurfacing of Road Agency Private Ltd. & Another Versus C.B.I. reported in (2018) 16 SCC 299. The report must be received within eight weeks from the date of receipt of this order.
