With consent of the parties, hearing of the matter has been done

through video conferencing and there is no complaint whatsoever regarding

audio and visual quality.

It has been informed on behalf of the appellant that he has already

entered appearance into the proceeding which is pending under Section 34

of the Arbitration and Conciliation Act. Learned counsel for the appellant

has submitted that since there is a likelihood of the matter to be heard and

disposed of in near future, he does not want to press this appeal.

Accordingly, this appeal is dismissed as not pressed.

However, this goes without saying that the concerned Court, which

is in seisin of the aforesaid pending matter, should proceed and dispose of

the same as expeditiously as possible.
