Heard, learned counsel for the petitioners, Mr. Vishal Kumar Tiwary and learned counsel for the respondents, Mr. Anil Kumar Sinha.

Learned counsel for the respondents, Mr. Anil Kumar Sinha has submitted that counter-affidavit has been filed on 19.01.2018 stating therein that final decree has already been signed on 10.11.2017 in Partition Suit No. 147/2008, as such, the present writ petition has become infructuous, which has been filed for quashing the order dated 03.08.2016 passed by learned Civil Judge, Senior Division-I, Ranchi in Partition Suit No. 147/2008, whereby petition dated 26.07.2016 for passing an appropriate order for directing the Pleader Commissioner to carve out the share of these petitioners, separately in the suit property in light of the judgment & decree has been rejected.

Since the final decree has already been brought on record, as such, the writ petition is dismissed as infructuous.

I.A. No. 8491/2017 stands closed.
