2. This revision application is directed against the judgment dated 19.2.2009 passed by learned Chief Judicial Magistrate, Seraikella, corresponding to G.R. No.373/05, arising out of Chandil P.S. Case No.72/05; whereby the opposite parties were acquitted from the charges under Sections 147, 341, 323 and 448 IPC.
3. Mr. A. K. Das, learned counsel for the petitioner assisted by Mr. Gaurav V. Sahay fairly submits that the matter has been compromised between the parties and both the parties does not want to proceed further with the matter; as such upon instruction from his client he does not want to proceed further with the instant case.
4. Learned counsel for O.P.No.2-13 also supported the submission of the learned counsel for the petitioner and submits that the matter may be dismissed as not pressed.
5. In view of the aforesaid submission, the instant criminal revision is hereby dismissed as not pressed. Let the lower court record be sent to the court concerned forthwith.
