05/22.8.2022 Heard learned counsel for the parties.

2. This revision application is directed against the

judgment dated 29.03.2004 passed by learned Sessions

Judge, Dumka in Criminal Appeal No.14/04; whereby the

judgment of conviction and order of sentence dated

24.01.2004 passed by the learned Judicial Magistrate, 1st

Class, Dumka, corresponding to G.R. Case No.907/01, T.R.

No.160/2004; whereby the petitioner nos. 2 & 3 were

convicted u/s 323/341 of the IPC and petitioner no.1 was

convicted under Section 324 IPC and directed them to

execute probation bond of Rs.2,000/- with two sureties to

maintain peace and good behavior for two years under

Section 4 of Probation of Offender Acts.

2. At the outset, Mr. Sanjay Singh, learned counsel

for the petitioners submits that after conviction the

petitioners were released on execution of Probation bond of

Rs.2000/- to maintain peace and good behavior and the

probation bonds were filed by the petitioners on

15.09.2004 and since then they have not committed any

crime till date; as such the revision application become

infructuous.

3. Learned APP supported the contention of the

learned counsel for the petitioner.

4. In view of the aforesaid submission since the

probation bonds were already executed on 15.09.2004

nothing remains to be adjudicated and the petitioners do

not want to press this case on merit, as such the instant

revision application is hereby disposed of as infructuous.
