Order No. 11: Dated: 10th August, 2022 Learned counsel for the parties is present. Let the name of Mr. Ashok Kumar, learned A.P.P. be reflected in the cause list.

Learned counsel for the petitioner submits that pursuant to the previous order the substituted service of notice to the O.P. No. 2 have been completed by getting the notice published in the local newspaper Prabhat Khabar dated 16.03.2022 and the cutting of the concerned newspaper has also been annexed along with supplementary-affidavit.

But, no one has appeared for the O.P. No. 2 despite the substituted service of notice to him.

One more opportunity is given to the O.P. No. 2 to appear before this Court.

Learned A.P.P. is directed to take necessary steps through the concerned police station to ensure the presence of the opposite party no. 2 either through himself or through his counsel and submit the report before this Court, as to whether the notice has been served through the concerned police station or not, by the next date positively.

In the meantime, let the status report be called for from the concerned Court regarding the status of the case in the light of the judgment passed by the Hon'ble Supreme Court in the case of Asian Resurfacing of Road Agency Private Ltd. & Another Versus C.B.I. reported in (2018) 16 SCC 299. The report must be received within four weeks from the date of receipt of a copy of this order.

Put up this case on 20.10.2022.
