05 / 08.08.2022 Heard learned counsel for the parties on the prayer for condonation of delay of 78 days in preferring the instant Memo of Appeal made through I.A. No. 4458/2019.
2. Learned counsel for the appellant submits that the appellant took some time in obtaining certified copy of the impugned judgment passed in WPS No. 6059/2015. Thereafter, appellant consulted his Advocate in the High Court and also took time to manage money including fee for filing this appeal. Appellant has got a good case, but he may suffer irreparably if delay is not condoned, though there are no deliberate laches on his part.
3. Learned counsel for the State does not have serious objection to the prayer.
4. On consideration of the explanation urged and submission made on behalf of the parties, delay is condoned. I.A. is disposed of.
5. Let the case be listed under the heading 'For Admission'.
