05/ 26.04.2022 Heard the parties.
Learned counsel for the respondents submits that though this Court had passed an order for releasing salary from July, 2021 onwards, if there is no other impediment in releasing the same, but in view of Annexure-9 & 15, the petitioners are not entitled for salary as their cases falls within category of New Pension Scheme. However, same is disputed by the learned counsel for the petitioners and it is submitted that Annexure-9 & 15 are not in consonance with the Judgment of Full Bench of this Hon'ble Court, reported in (2005) 3 JLJR 38.
The respondents are directed to release 50 % of the salary of the petitioners from July, 2021 onwards, subject to out come of this writ petition, within a period of three weeks.
The petitioner is directed to implead Accountant General as a party respondent in the array of the parties, in course of the day with red ink.
Let two copies of writ petition be handed over to Mr. Sudarshan Srivastava, learned counsel appearing on behalf of the newly added respondent.
Put up this case after three weeks.
