The present interlocutory application has been filed on behalf of the petitioner for suspension of sentence, during pendency of the instant criminal revision petition.

The instant criminal revision has been filed against the judgment and order of conviction and sentence dated 15.10.2020 passed by the learned Distt. And Addl. Sessions Judge-II-cum-Special Judge, Anti Corruption Bureau, Cyber Cases and Electricity Act, Dhanbad in Criminal Appeal No.03 of 2018, affirming the order of sentence and conviction dated 23.12.2017 passed by the Judicial Magistrate, 1st Class, Dhanbad in G.R. No.3805 of 2016, (T.R. No.679 of 2017) whereby the petitioner has been convicted for the offence under Sections 25(1-B)a and 26 of the Arms Act and the petitioner has been sentenced to undergo S.I. for six months each for the offence under Sections 25(1-B)a and 26 of the Arms Act with fine.

It has been submitted by learned counsel for the petitioner that the revisionist has remained in custody for more than four months out of the sentence imposed by the court below.

On the other hand, learned APP has opposed the prayer for bail. In the attending facts and circumstances of the case, I am inclined to suspend the sentence of the petitioner. Accordingly the petitioner named above is directed to be enlarged on bail, on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Dhanbad in G.R. No.3805 of 2016, (T.R. No.679 of 2017).

I.A. No.5773 of 2021 stands disposed of.
