6/Dated: 03/11/2021 This petition has been heard through Video Conferencing in view of the
guidelines of the High Court taking into account the situation arising due to COVID-19
pandemic.
Mr. Ankit Kumar, learned counsel for the petitioner submits that the case
is in hand is civil in nature for that criminal proceeding has been initiated against the
petitioner. He submits that this Court is competent to quash F.I.R. sitting under
Section 482 Cr.P.C. He relied on judgment in the case of "Paramjeet Batra V. State
of Uttarakhand & Others" reported in (2013) 11 SCC 673.
It transpires that investigation is still going on. At this stage, the Court is
not inclined to exercise its power under Section 482 Cr.P.C.
At this stage, Mr. Ankit Kumar, learned counsel for the petitioner seeks
permission to withdraw this petition with liberty to take all the points at the
appropriate stage.
Accordingly, this criminal miscellaneous petition is disposed of with the
aforesaid liberty.
