1. This revision petition has been filed for the following reliefs: -

"That the instant application is directed against the judgment dated 28/09/2013 passed in Criminal Appeal No. 09/07 by Sri Alok Kumar Dubey, learned District & Additional Sessions Judge 3rd, Chatra, (appeal arising out of judgement of conviction and order of sentence dated 12.04.07 passed by Sri Birendra Pratap, learned Judicial Magistrate, Chatra) arising out of Chatra P.S case No-141/97 corresponding to G.R. case No. 493/97, T.R. Case No. 618/07, whereby and where under the petitioners have been held guilty for the offences punishable under section 324 and 323 of Indian Penal Code and Petitioner No. 2 has been convicted for the same and ordered to enter a bond of Rs. 1000 and a direction to keep peace and good behavior for one year and Petitioner No. 1 was released after due admonition which is illegal being perverse and disproportionate."

2. Learned counsel for the petitioner Mr. Anup Kumar Agarwal upon instruction from his clients seeks permission to withdraw this petition.

3. Learned counsel for the opposite party-State Mr. Vishwanath Ray has no serious objection to the prayer made.

4. Accordingly, the present revision petition is dismissed as withdrawn.

5. Pending interlocutory applications, if any, are closed.

6. Let the Lower Court Records be sent back to the court concerned.

7. Let a copy of this order be communicated to the learned court below through 'e-mail/FAX'.
