06/06.07.2021 Heard Mr. Sanjay Kumar Tiwari, learned counsel for the petitioner and Mr. Manoj Kumar Mishra, learned counsel for the State.

This criminal miscellaneous petition has been heard through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic.

Notice upon opposite party no.2 has not been served. Service report is there by which it has been informed that she has not been served.

Learned counsel appearing for the petitioner shall take fresh steps for service of notice upon opposite party no.2 on her present and correct address under registered cover with A/D as well as by ordinary process for which requisites etc. must be filed within two weeks.

The petitioner may effect personal service of notice upon the opposite party no.2 for which requisites must be filed within two weeks and office shall issue draft of personal service of notice upon the counsel for the petitioner thereafter so that steps can be taken for personal service.

Learned counsel appearing for the petitioner submits that in view of judgment rendered by in the case of Asian Resurfacing of Road Agency Pvt. Ltd. & Anr. Versus Central Bureau of Investigation reported in 2018(2) JLJR 320, interlocutory application was required to be filed. He submits that opposite party no.2 has not appeared. He submits that interim order may kindly be extended.

In view of aforesaid facts, I.A. No.2737 of 2021 is allowed and disposed of.

Interim order dated 01.12.2020 shall remain in force till the next date. Post this matter on 02.11.2021.
