10 / 08.01.2021. Heard, learned counsel for the appellants.

Learned counsel for the appellants has submitted that appellants/claimants, Ambika Devi, Bishnu Pada Mondal, Suresh Mondal and Rita Kumari have preferred this Misc. Appeal against the judgment and award dated 02.05.2013 passed by learned District Judge 1st -cum- M.A.C.T., Bokaro, in T. M. V. No.87 of 2009 whereby the claimants have been awarded compensation to the tune of Rs.21,29,420/- without interest.

Learned counsel for the appellants/claimants has further submitted that there is delay of 187 days in preferring the instant Misc. Apeal and for condonation of same, I.A. No.9943 of 2018 has been filed and copy of which has already been served upon learned counsel for the respondent-Insurance company.

Learned counsel for the respondent has opposed the prayer and submitted that this case may be posted for admission in the next week.

Considering rival submissions of the parties and since no counter- affidavit has been filed in the limitation petition, the delay of 187 days in preferring the instant Misc. Appeal is hereby condoned, considering it to be a benevolent legislation.

Put up this case on 12.01.2021 under the heading 'For Admission'.

The aforesaid I.A. stands disposed of.
