03/10.02.2021:            In this writ petition, the petitioner has prayed for registering an FIR,

which, according to the petitioner, has not been registered, though a cognizable offence is made out.

In view of the judgment passed by this Court in W.P.(Cr.) No. 233 of 2018 (Kabirul Islam Vs. State of Jharkhand and Ors.) considering the several judgments passed by the Hon'ble Supreme Court of India, this Court is of the opinion that the prayer for registering the FIR cannot be entertained by this Court. However, the petitioner is at liberty to approach the court below in term of the aforesaid judgment.

So far as the grievance of the petitioner with regard to investigation and non-arresting of the accused persons is concerned, in view of the judgment cited above and the judgments of the Hon'ble Supreme Court, which have been relied upon by me in that judgment, the petitioner is at liberty to file an application before the appropriate court, which will be looked into and appropriate order will be passed by the court concerned.

With the aforesaid observation and direction, this writ petition stands disposed of.
